Herald Leader: Clark County's Schools

Interesting article from the Herald-Leader over the weekend:

WINCHESTER — When teachers crank up the computer lab's air conditioning at Central Elementary School, someone must plop a bucket in the hallway to catch the condensation water that starts falling from the gaping hole in the ceiling.

At nearby Fannie Bush Elementary School, dozens of desks are pushed together in classrooms nearly 20 percent smaller than recommended. The 275 students share one set of boys and girls bathrooms. Some classes are held out back in rotting, wind-rattled trailers.

Built more than half a century ago, Central and Fannie Bush are two of 18 Kentucky schools currently classified as Category 5 by the state Education Department.

On a 1-to-5 scale, they are the oldest and most decrepit of the state's roughly 1,200 school buildings. All are at least 40 years old. Some date back to the 1920s, with creaky wood floors, leaky roofs, inadequate coal-fired heat and antiquated plumbing. Few have classrooms of sufficient size or that are wired for modern teaching standards.

The schools briefly were in the news in June as the legislature debated allowing slot machines at racetracks. House Speaker Greg Stumbo said his slots bill would generate $850 million to replace all schools in Category 5 — Stumbo called them "awful" — and some of the nearly 200 schools in Category 4 that are barely any better.

But the slots bill died, and the legislature adjourned until January.

Meanwhile, thousands of children started classes this fall at crumbling, cramped schools. This comes 20 years after the state Supreme Court ruled in a landmark school-funding decision that "students must be given equal educational opportunities, regardless of economic status or place of residence."

Most Kentucky schools are in categories 1, 2 or 3, which means they're in excellent, good or average shape. They were built in the last 30 years or had major renovations.

In prosperous Fayette County, for example, three-fourths of schools are in categories 1 and 2. But poor and rural Robertson County has a single school to hold all grades. It was built shortly after World War I, and it's a Category 5 with a laundry list of problems that complicate daily life for students.

"We've tried to add on where we could and do repairs. But at some point, there's not a lot more you can do for an 80-year-old building other than keep repainting it," said Jeremy McCloud, principal of Robertson County's Deming School.

Finding the money

State and local school officials and lawmakers say they're trying to address the problem of aging schools as best they can given the sour economy.

Kentucky has seen progress in replacing or renovating Category 5 schools, although that's small consolation to a child now enrolled in one, said Mark Ryles, facilities management director at the state Education Department.

The number of such schools has dropped by nearly half since 2003, when the legislature established the Urgent Needs Trust Fund. In three rounds of funding, ending in 2006, lawmakers approved $275 million in bonding authority to address many of the worst schools in more than 50 school districts, according to the department.

However, lawmakers say they're unable to replenish the fund because there is no more money or bonding capacity. House Democrats unsuccessfully sponsored a bill last winter to appropriate tens of millions of dollars for Category 5 schools in a few specific counties.

Inaction aggravates the problem, said Rep. Tommy Thompson, D-Owensboro, who chairs the House budget subcommittee for education.

Every year, Category 4 schools grow older and more decrepit, Thompson said. The state uses architectural surveys to classify the schools, but many lawmakers suspect they have Category 4 schools in their districts that should be dropped one rank and replaced, he said.

"We all agree that we really need to revisit this," Thompson said. "It's critical that we give our children the best environment in which to learn. Unfortunately, we sometimes fail to do that."

Stumbo, the Democratic House speaker from Prestonsburg, said he still hopes for revenue from slot machines, which the Republican-led Senate is blocking.

"I still think the best way to fund Category 5 schools is through expanded gaming," Stumbo said. "When the dynamics change in the Senate — and I'm convinced they'll change — that bill will pass."

Local obstacles

Part of the problem in addressing Category 5 schools lies in the state asking for more than local school officials say they can give.

The state Education Department spends about $600 million a year on school construction through several funding streams, not all of which take into account a school district's wealth or poverty, Ryles said.

School districts are expected to bring money to the table for their projects, which is why the legislature should require participating districts to up the minimum property tax that funds school construction, Ryles said.

At present, he said, the majority of districts levy a 5-cent tax on every $100 in assessed property value to fund school facilities. Other districts get 10 to 15 cents and, therefore, can afford to build more. The state Education Department wants the minimum tax rate set at 10 cents.

However, school officials in poor districts say it's next to impossible to find the local money to go along with state funding.

Robertson County, for instance, was given $5 million from the state's Urgent Needs Trust Fund to replace its school. But a new school could cost $20 million, said principal McCloud. Unable to make up the difference, the county stares at the $5 million sitting in an escrow account in its name.

"We have 2,200 people living here, and we just don't have that kind of tax base," McCloud said.

Also, to cut costs, the state asks districts to consolidate smaller schools. It makes no sense to spend $10 million or more replacing an old school with a dwindling student population when it can be merged with a newer, larger school in the area, Ryles said.

Consolidation causes its own headaches.

Families near small schools get angry when a closing is announced and the district plans to bus their children elsewhere. Some rural school superintendents say it isn't realistic to shutter their Category 5 school and send children elsewhere because the next school is nearly an hour's drive away.

Finally, in the legislature, talk about school construction leads to partisan wrangling over the state's prevailing wage law, which mandates higher pay for workers on major construction projects built with public funds.

Generally, Democrats support the law and Republicans fight for its repeal. Echoing the GOP, 96 percent of school officials in a 2001 Legislative Research Commission survey said the prevailing wage drives up their project costs; only 4 percent said it improves quality.

While policy-makers decide their next step, Fannie Bush Principal Angela Taylor squeezes a 54th year out of her Winchester school. The few closets are converted for other uses, such as a nurse's station. The cafeteria doubles as the gymnasium once tables are removed so children can exercise.

"For us, the biggest issue is space, in that we don't have any," Taylor said. "We do the best we can. We're getting good at that."

$4.3 Million for ICCs = $50 Million for “Deteriorated” Schools

During the special session, this was reported in the Courier-Journal:

“(House Speaker) Greg Stumbo said it would require a bond issue of about $700 million, or slightly more than $60 million in annual debt payments to replace all 160 schools.”

For the sake of discussion can we assume that for every $1 million in annual debt payments – the state gets $11.6 million in bonded funds? ($700 / $60 = $11.66) Sure – why not.

So – using this simple logic – is it reasonable to suggest that the $4.3 million that the state puts into the ICC program could provide $50.13 million to replace Kentucky’s “deteriorated” schools?

Let’s look at the most recent list of Category 5 schools in Kentucky:

So – can we conclude that if the legislature redirected the funds currently dedicated to the ICC program toward bonding for school facilities – we could provide enough resources to completely address Kentucky’s Category 5 problem within two budget cycles?

Let’s see: $4.3m x $11.66m = $50.13m. And $50.13m x 2 (the number of budget cycles) = $100.26 million. There’s even some to spare to get to work on Category 4 schools.

Now, we admit that we’re being a bit sarcastic about the exercise – but let’s look beyond the tone and look at the substance.

We’re told Kentucky is in “fiscal crisis” and we need to be prepared to continue “tightening the belt” (which we support). But what we must also take into account is whether the dollars we are currently spending are producing enough return to justify their ongoing appropriation. It would be nice to know if the ICC programs are doing that. Why?

Because if not, we just found $50m in the next biennium to fix Kentucky’s “deteriorated” schools.

* Fannie Bush Elem is listed as a Category 5 school though with $0 in facility needs. There is a note to “see Conkwright Middle” which is a Category 4 school in Clark County with a resource requirement of $8.6m. It is unclear exactly what this means, though. So we have left Fannie Bush Elem. off this list. Further, Pilot View Elem in Clark County is a Category 5 school but also with a $0 facility need. Any other Category 5 school in the state that had a $0 resource requirement was not included.

Better Schools - The Dialogue Reaches Across the State

As we posted yesterday, the special session will be seen as a very important step forward on ensuring that Kentucky children are attending adequate schools. Quite simply - the genie is out of the bottle. The Kentucky public is now more aware than ever before of the awful condition of certain schools, which the Kentucky Department of Education calls "deteriorated."

Don't just take our word for it - check out the NewsRoom for links to the dialogue unfolding in Kentucky. Some highlights:

House Speaker Greg Stumbo got things going in the Lexington Herald-Leader when he said, "I'm a proponent of building schools," said House Speaker Greg Stumbo, D-Prestonsburg. "We're looking at a proposal which we believe can act as an economic stimulus package and also help eliminate some of the awful ... schools we have in the state."

The Bowling Green Daily News opined on their editorial page that the "prevailing wage is a government enforced price fixing conspiracy on projects, such as schools, where public funds are involved. Rather than allowing the free market to deliver the best value, these laws require labor prices established at the prevailing (which is to say union) rate...

When you consider that the Kentucky Department of Education reported that the state’s prevailing wage policy increased school construction costs almost $500 million between 1999 and 2004, it becomes obvious that a small special interest group is extracting serious money from a much larger group - the taxpaying citizens."

In the Hardin County News Enterprise,Rep. Tim Moore, R-Elizabethtown, said he believed "the General Assembly should look for cost-cutting measures rather than new avenues of spending. He said there are other ways to cut expenses that the General Assembly is avoiding. For instance, Moore said the state’s prevailing wage — a median wage paid to workers in a specified location — puts an additional expense on the price of every construction project in the state with no just cause for doing so."

The Bluegrass Institute weighed in saying,“Kentucky’s process of determining wages on schools and courthouses is costly, inefficient and harmful to our economic well-being.”

Just yesterday, Mike Duncan, one of Kentucky's most prominent and well-respected leaders of his generation, was quoted as saying,“One thing that I have seen proposed recently is on prevailing wage for school facilities. If we weren't paying a prevailing wage on local courthouses and school facilities, it would save hundreds of millions of dollars for the citizens of Kentucky."

The Coalition hopes that the conversation continues leading into the 2010 Session. Our children's future depend upon it. We owe it to them to keep it up.

Session May Wrap Up Today

Indications are that the special session could wrap up today with a quick agreement on the budget- balancing bill and perhaps action on the incentive and bridge's legislation. Anything can happen but there is a lot of agreement on these items and the slots bill went down in committee yesterday, thereby removing the most contentious and time consuming piece of the agenda.

Though the Coalition would have liked to have seen this special session move ahead on Better Schools for Kentucky's students - in the final analysis though, we believe that the session will be seen as a very important step forward on ensuring that Kentucky children are attending adequate schools. Quite simply - the genie is out of the bottle. The Kentucky public is now more aware than ever before of the awful condition of certain schools, which the Kentucky Department of Education calls "deteriorated."

The opportunity to continue to move toward a solution for these schools and the students that attend them is before us. The Coalition intends to continue to advocate in the coming months on their behalf.

Kentucky Opportunity Coalition Calls for Repeal of Prevailing Wage On Education Projects

The Kentucky Opportunity Coalition calls for the Kentucky General Assembly to permanently repeal the prevailing wage provision on education projects. The special session has made the issue of school facility conditions a priority facing the Commonwealth. The Kentucky House of Representatives passed H.B. 2 which included almost $1.3 billion for education facilities, most of which will be used to rehabilitate or replace all of Kentucky's Category 5 schools, Category 4 schools that might be reclassified as Category 5 and to aid overcrowded schools.

"The Coalition firmly believes that we must invest in our children's future by investing in these schools," stated Kristen Webb Hill, Chair of the Kentucky Opportunity Coalition. "In order to do what's best for our students during these tough economic times, we should maximize those dollars instead of diverting one penny of these resources toward artificially inflated wages."

The Kentucky Legislative Research Commission (LRC) has reported that the wage portion of prevailing wage projects is more than 20% higher than if area market-based wages were utilized. That translates into an estimated 10% of total project costs that are underutilized due to the prevailing wage requirement.

"If we are going to make the commitment, let's maximize our investment dollar," said James E. Milliman, the Coalition's vice-chairman. "Instead of potentially directing nearly $130 million toward artificially inflated wages, let's invest that money in the next generation of Kentucky's minds."

The LRC report also revealed that 95% of school district respondents said that prevailing wage requirements increase the cost of construction while only 4% said that the prevailing wage enhanced the quality of construction.

"If we want economic stimulus, we must create opportunities for small businesses to compete," said Milliman. "Research shows that the prevailing wage requirement makes it hard for smaller businesses to bid on these projects."

The LRC report stated that, “If the prevailing wages for the area are higher than the wages being paid in the area, it might reduce local contractors’ ability to compete for public projects in the locality.”
